Connection of RES at preferential prices under RESA terminated since 27 December 2013
ENERGO-PRO Grid has received a letter from the Deputy Minister of Economy and Energy ref. ¹ E-91-00-26/27.01.2014 regarding: "Presenting information on the implementation of mandatory national target of Bulgaria for the share of energy from renewable sources by 2020."
With the letter in question we were informed that in pursuance of Art. 13, para. 1 of the Renewable Energy Sources Act ( RESA ), on 27 December. 2013 was sent to the European Commission the prepared by the Ministry of Economy and Energy Second National Report on the progress of the promotion and use of renewable energy sources, which reports on the implementation of National Action Plan for Renewable Energy Sources (NAPRES) for the period 2011-2012. Data in the report shows that in 2012 the share of energy from renewable sources in gross end consumption of energy in the country has reached 16.4 %.
According to Art. 12, para. 1 of RESA and NAPRES the mandatory national target of Bulgaria by 2020 is to achieve a share of 16 %, i.e. with the report is accounted for its implementation and available is the condition for the application of the stipulation of Art. 18, para. 2 of RESA: " Stimulations under para .1, items 5 , 6 and 7, the procedure for connection in Section II, as well as art . 31 and 32 do not apply to energy facilities for the generation of electricity from renewable sources, which are reported for connection after the date of the report of the Minister of Economy and Energy on Art. 13 , para 1, in which it is reported that the national target under Art. 12, para. 1 is achieved. "
In this respect, to the installations for the generation of electricity from renewable sources, reported for connection after 27 Dec. 2013, should not be applied the obligation to buy the produced electricity at preferential prices based on long-term contracts and the procedures for connection in Section II, Chapter Four of RESA. Connection has to be made in compliance with the stipulation of Art. 116, para. 7 of the Energy Act in accordance with Art. 1, para. 2 of RESA, namely Ordinance ¹ 6 for connecting consumers and generators to the electricity transmission and distribution grids. Therefore, after this date should be planned and approved electrical facilities that can be provided for connection to the transmission and distribution grids of sites for the production of electricity from renewable sources by regions of connecting and voltage levels, in accordance with Art. 22 of RESA.
According to Art. 18, para. 6 of RESA, connecting facilities to the electricity distribution grid of ENERGO-PRO Grid as of Art. 24, item 1 of RESA will be done in accordance with Art. 26 of the same.
As of January 30, 2018, the power distribution company in Northeastern Bulgaria "ENERGO-PRO Grid" AD changed its name to "Electrodistribution North" AD. The company is taking this step to meet the requirements of the European Directive 2009/72/EC and the Bulgarian Energy Act. ENERGO-PRO Grid held a public discussion of the draft of new General Terms and Conditions for Access and Transmission of electric power over the electricity distribution grid (GTC) on May 14, 2013.
